1. Service Description
FairRate (“we,” “us,” “our”) provides an online mortgage data benchmarking service. Our tools compare user-provided mortgage rates and loan estimate fees against publicly available market data to help consumers understand how their loan terms compare to the broader market.
FairRate provides informational data benchmarking only. Nothing on this site constitutes financial, legal, tax, or investment advice. Our analysis is based on aggregated market data and the figures you provide. We make no representation that any output reflects advice tailored to your individual circumstances.
2. Not a Financial Services Provider
FairRate is not a mortgage lender, mortgage broker, financial advisor, or fiduciary. We do not originate loans, take loan applications, issue pre-approvals, or earn any revenue from lenders or other financial institutions. We have no affiliation with any lender and do not refer users to specific lenders. Do not rely on our analysis as a substitute for advice from a licensed mortgage professional.
3. Payment Terms
- The Rate Checker costs $19 as a one-time fee.
- The Loan Estimate Analyzer costs $29 as a one-time fee.
- All payments are processed securely by Stripe. By completing a purchase you agree to Stripe's terms of service.
- No refunds are issued after your analysis has been delivered. Because our service delivers a digital report immediately upon payment, all sales are final once analysis results are provided. If you experience a technical failure that prevents delivery of your results, contact us at support@fairrate.online and we will resolve it.
- Prices are in USD and are subject to change without notice for future purchases.
4. Limitation of Liability
Our analysis is produced from market data sources and the figures you confirm before payment. You are responsible for verifying that the numbers you submit accurately reflect your loan documents.
FairRate is not liable for any mortgage decisions, financial losses, or other consequences arising from your use of, or reliance on, our analysis. To the maximum extent permitted by applicable law, FairRate's total liability to you for any claim arising from your use of the service shall not exceed the amount you paid for the specific analysis at issue.
We make no warranty, express or implied, that our benchmarks are accurate, complete, or current for your specific loan scenario, geographic market, or time of analysis. Market conditions change and our data may not reflect rates or fees available at every lender.
5. Acceptable Use
By using FairRate you agree to use the service solely for your own personal, non-commercial purposes. You agree not to:
- Scrape, copy, resell, sublicense, or redistribute our analysis output or benchmarking data.
- Use the service on behalf of a third party without their knowledge and consent.
- Attempt to reverse-engineer or extract our underlying datasets or methodology beyond what we publish.
- Submit false, misleading, or fraudulent information.
- Use automated tools, bots, or scripts to access the service.
We reserve the right to suspend or terminate access for any user who violates these terms.
6. Intellectual Property
All content on FairRate — including our methodology, scoring logic, copy, and design — is owned by FairRate and protected by applicable intellectual property laws. You may not reproduce or distribute any content from FairRate without our written permission.
7. Disclaimer of Warranties
The service is provided “as is” and “as available” without any warranty of any kind. We do not warrant that the service will be uninterrupted, error-free, or that any defects will be corrected. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.
8. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of FairRate shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
9. Changes to These Terms
We may update these Terms at any time. Changes take effect when posted. Continued use of FairRate after changes are posted constitutes your acceptance of the updated Terms. The “Last updated” date at the top reflects when the Terms were last revised.
